A Nairobi-based lawyer, Salim Ali Mwadumbo, accused of defrauding a deceased individual’s estate of land valued at Ksh 110 million, failed to appear in court yesterday to face charges. The case was scheduled to be heard before Milimani Principal Magistrate Benmark Ekhubi.
Mwadumbo’s lawyer informed the court that his client was unwell and requested a one-week deferment for him to recover. “Your honour, my client is sick and has been given bed rest. We are seeking to defer the plea for one week as he recuperates,” the defense argued.
However, the complainants’ representative opposed the request, calling for a warrant of arrest to be issued. The magistrate noted discrepancies in the medical documentation submitted. The document indicated only a one-day bed rest and was transmitted via phone, which the court found unsatisfactory.
Magistrate Ekhubi directed that Mwadumbo appear in person this morning (Thursday) to take his plea.
The charge sheet presented in court alleges that Mwadumbo, “on or before November 5, 2011, at an unknown location within the country,” conspired to defraud the late Modhihiri Mohamed of land. The accused is currently out on a cash bail of Ksh 100,000.
