The Aga Khan Hospital Mombasa has come under fire from stakeholders for delays in finalizing provisions of a Collective Bargaining Agreement (CBA) with the Kenya Union of Domestic, Hotels, Educational Institutions, and Hospital Workers. The ongoing labour dispute centres on seven contentious clauses that remain unresolved in the 2022/2023 CBA.
Key sticking points include medical treatment (Clause 21), gazetted public holidays (Clause 23), long service awards (Clause 38), commuter allowance (Clause 39), on-call allowance (Clause 40), house allowance (Clause 29), and leave travelling allowance (Clause 4).
Union representatives claim the hospital management has agreed to address these issues progressively but has failed to finalize them, despite numerous meetings. Consequently, the union has requested that the hospital be compelled to complete the negotiations within 21 days to ensure compliance.
The dispute has highlighted employee grievances, including the lack of long-service awards for dedicated staff and inadequate compensation for extended working hours and public holidays. Workers also demand allowances for commuting and leave-related travel to ease financial burdens.
On December 17, 2024, Judge M. Mbaru of the Employment and Labour Relations Court ordered both parties to finalize the CBA within 30 days, potentially setting the stage for a resolution.
