Nandi Hills MP Benard Kitur has petitioned Data Protection Commissioner Immaculate Kassait over the use of drones in a residential estate, citing concerns over a potential breach of privacy. In a letter addressed to the Commissioner, Kitur has called for an investigation into Eastern Produce Tea Company’s deployment of surveillance drones in Kimasas Cooperative’s Sitoi estate. The estate houses a significant workforce from the multinational tea company in Nandi County.
The United Democratic Movement (UDM) lawmaker has urged the Commissioner to intervene, arguing that the drone operations raise serious privacy concerns. He alleged that Eastern Produce was using drones to monitor tenants’ activities, including those of squatters who had been allocated land following a court order.
“While I understand the importance of maintaining security, the manner in which these drones are being operated without the consent of residents may constitute a breach of privacy under the Data Protection Act, 2019,” stated Kitur.
The MP further noted that the surveillance had caused undue distress and created an atmosphere of intimidation among lawful occupants of the estate. He called on the Commissioner to determine whether Eastern Produce obtained the necessary approvals and provided justifiable reasons for conducting aerial monitoring in the area.
Kitur has also urged Kassait’s office to ensure that the rights of Kimasas residents are upheld in line with existing privacy laws. “Your prompt action in addressing this matter will help safeguard the dignity and privacy of the residents while fostering trust in our institutions,” he added.
The MP further highlighted concerns that residents rely on open washrooms, and the presence of drones capturing images and videos could infringe upon their privacy. “Squatters use open washrooms and temporary toilet structures, and the presence of drones taking pictures and videos may make them uncomfortable and violate their right to privacy,” argued Kitur. He now wants the Data Protection Commissioner to expedite investigations and take appropriate action to address the concerns raised by the affected residents.
