Governor Natembeya Charged with Conflict of Interest, Released on Bail

Trans Nzoia Governor George Natembeya was charged with corruption-related offences and released on bail yesterday following his arraignment before Principal Magistrate Charles Ondieki. He pleaded not guilty to three charges brought by the Director of Public Prosecutions (DPP), including the unlawful acquisition of public property and two counts of conflict of interest, contrary to the Anti-Corruption and Economic Crimes Act, 2003.

According to the DPP, between January 1, 2023, and April 30, 2025, Natembeya allegedly unlawfully acquired Ksh 3,252,568 through payments made by the County Government of Trans Nzoia to Lyma Agro Science Limited, Maira Stores, and Easterly Winds Limited. These companies are allegedly owned by individuals with close ties to the governor.

Specifically, the prosecution claims Natembeya indirectly benefited from Ksh 1.12 million through Mercy Chelangat, the director of Lyma Agro Science Limited and proprietor of Maira Stores, and a further Ksh 2.12 million through Emmanuel Wafula Masungo, the beneficial owner of Easterly Winds Limited.

The court granted the governor a cash bail of Ksh 500,000 with two contact persons or an alternative bond of Ksh 1 million with one surety. However, strict conditions were imposed: Natembeya is barred from accessing his office for 60 days, cannot leave the court’s jurisdiction without permission, and must not interfere with witnesses or comment on the case in public or through the media. He is also prohibited from leaving the country unless cleared by the court.

The prosecution has been directed to provide all documentary evidence and exhibits to the defence before the matter is mentioned again on June 4, 2025.
