Suspension from the Roll of Advocates means that the two lawyers are legally barred from practising law, including representing clients in court or engaging in any other professional work such as conveyancing.
Samuel Ndungu King’ori, who was admitted to the Kenyan Bar in 2011, was suspended by the Tribunal on 12th March 2025.
The Chief Registrar of the Judiciary, Winfridah Mokaya, announced this on 24th June 2025 as follows:
“PURSUANT to section 69(2) of the Advocates Act (Cap. 16), Laws of Kenya, it is notified for the information of the general public that final orders were made, and Samuel Ndungu King’ori (Advocate) – P.105/8800/11 was suspended from the Roll of Advocates for a period of three (3) years with effect from 12th March 2025, by the Disciplinary Tribunal pursuant to an order issued in DTC/142/201.”
On the same day, she also announced the suspension of Lydiah Nthenya Mutisya from legal practice. Mutisya, who was admitted to practice in Kenyan courts in 1995, will similarly not be allowed to do so for the next three years.
The Registrar stated:
“PURSUANT to section 69(2) of the Advocates Act (Cap. 16), Laws of Kenya, it is notified for the information of the general public that final orders were made, and Lydiah Nthenya Mutisya (Advocate) – P.105/2836/95 was suspended from the Roll of Advocates for a period of three (3) years with effect from 3rd March 2025, by the Disciplinary Tribunal pursuant to an order issued in DTC/9/2018.”
The Advocates Disciplinary Tribunal (ADT) plays a crucial role in upholding the standards of the legal profession in Kenya. Established under Section 57 of the Advocates Act, it is mandated to hear and determine complaints against advocates.
Where a case of professional misconduct is established against an advocate, the Tribunal may order that the advocate be admonished, suspended from practice for a period not exceeding five years, or that the advocate’s name be struck off the Roll.
The Tribunal may also order that the advocate pays a fine not exceeding one million Kenya shillings, or that the advocate compensates or reimburses an aggrieved person an amount not exceeding five million shillings.
