Esteem Energy’s Hassan Ibrahim Issak Faces Justice in Sh50m Fraud Case

A director of Esteem Energy Limited has been charged at the Milimani Law Courts with multiple counts of forgery and malicious damage to property in connection with a disputed piece of land valued at Sh50 million belonging to Eveready Security Guards Company Limited.

Hassan Ibrahim Issak appeared before Chief Magistrate Lucas Onyina, where he denied the charges. He was released on a cash bail of Sh200,000 pending the hearing and determination of the matter. According to the prosecution, Mr Issak is accused of forging a certificate of title for land parcel LR No. 209/22665 (original number 209/5924, IR No. 239781) located in South B, Nairobi. The land measures 0.0929 hectares and is the subject of an ownership dispute.

The forged title is dated 21st March 2022 and bears the name of Esteem Energy Ltd, purportedly signed and issued by one Charles Kipkurui Ng’etich, a fact the prosecution asserts the accused knew to be false.
In addition, Mr Issak faces another charge of forging a PPA2 document, No. 003094, dated 25th February 2020, allegedly issued by the then Nairobi City Council. The prosecution maintains that this document, too, was falsified with the intention of presenting it as genuine.

The accused is also facing a separate count of malicious damage to property. He is alleged to have unlawfully demolished an administrative block valued at Sh7,485,000, the property of Eveready Security Guards Company. This offence is said to have been committed on 5th September 2022 in South B, Nairobi County.

Mr Issak’s lawyer, Michael Osundwa, successfully applied for his client’s release on bail, arguing that he was not a flight risk and would cooperate with ongoing investigations. The court scheduled the matter for mention on 14th August 2025. The case is expected to shed light on growing concerns about fraudulent land transactions and document forgery in Nairobi’s property sector.
