In an affidavit sworn by Mr Nichat Umesh, he confirms that he was employed by Mediheal Group Ltd as the vice president of operations but at a very difficult time in the said hospital’s history, he was being harassed, his salary was constantly delayed and threatened to the extent that Mr Swarup himself would tell him that if he tried to leave or resign from employment, he would use extrajudicial means to assassinate him

A Former Senior Employee at Mediheal Group Ltd Nichat Umesh has badly exposed his former boss, Dr Swarup Rarjan Mishra, the Director/Chief Executive Officer (CEO) of the group. Mr Umesh was employed by Mediheal Group Ltd and seconded to Eldoret as a General Manager of the Mediheal Hospital & Fertility Centre on a contract on August 15, 2016, he was later promoted to the position of vice president- of operations, a position he held until on February 12, 2021, when he left.

In an affidavit sworn by Mr Umesh dated July 23, 2021, he stated that at the time of his dismissal from employment, he had risen to the rank of vice president of operations. He denied having used his work permit to further any personal ventures and/or used the same to further some illegal and/or per insectarium ends contrary to the provisions of the contract of employment under the Laws of Kenya.

In the affidavit, he revealed that his working relationship with Mediheal Group Ltd was one full of threats, servitude and slavery in the 21st century, thus he could not continue working for such an organization and as such he issued 2 resignation letters even though they didn’t acknowledge receipt of any of them.

He confirms that he was employed by Mediheal Group Ltd as the vice president of operations but during a very difficult tenure at the said hospital, he was being harassed, his salary was constantly delayed and threatened to the extent that Mr Swarup himself would tell him that if he tried to leave or resign from employment, he would use extrajudicial means to assassinate him.

In the affidavit, Mr Umesh confirmed that he issued with official laptop computer HP Envy x360 (corei7)/5CD7484197, 1TBHHD, 16GB RAM by the company for purposes of discharging his operational, financial, personnel and data access but denied claims that cannot be able to access information in the said laptop as at now.

He went on to reveal that he presented his resignation letter to the Hospital way back in the year 2018 but the Hospital failed and/or neglected to receive the said letter or take any action, instead, Mr Swarup chose to threaten him with dire consequences. He further revealed that he had resigned from the institution on two occasions July 17, 2018and January 23, 2021, as per clauses 4 and 20 of the employment contract. On both occasions, he was met with threats and hostility.

Having issued his notice of resignation, the Hospital withheld his salary for the period from November 2020 to February 10, 2021, when his notice period ended. As a result of the hospital’s refusal to accept his resignation and clear him in order to leave employment without any of their items he left with the hospital’s official laptop computer which he has since made arrangements to return but they have refused to receive any of their items simply because they did not want to accept his resignation.

He further revealed that during his tenure at the hospital, his salary was not being paid on time, constant harassment since 2018, thus he had to find other means to make some money in order to sustain himself and his family which was also in Kenya.

To make ends meet, he became part of the incorporation of Max Cure Hospital Limited and Maylove Medicare and Cure Hospital. They claimed that he used the data and trade secrets of the hospital in running these businesses.
