A Nairobi-based businessman Mohamed Abdi Madow has sued Bhachu Industries Limited at the High Court in Nairobi after he lost substantial amounts of money in a business deal that he now terms a scam.
Bhachu Industries Ltd is a manufacture of fuel tankers with a workshop along Enterprise Road Industrial, Nairobi. The deal between Mr Madow and Bhachu was that the company would manufacture a 24,000-litre fuel tanker and fit it on the businessman’s trailer, registration number KAT 071N. Mr Madow paid Ksh. 600,000 to Bhachu for the job. He made another payment of Ksh 35,000 for a spare tyre carrier and a toolbox on 11th November 2020.
Mr Madow collected the tanker in December 2020, and on 18th February 2021, he loaded fuel into the tanker and proceeded to DRC to make the delivery after securing a contract with Soma Petroleum Ltd to deliver 24,000 litres for a two-year contract.

The poor work has been attributed to Bhachu’s negligence and poor workmanship which made the tanker dislodge from the vehicle.
He later travelled back to Nairobi and lodged a formal complaint with the manufacturer followed by a series of meetings; Bhachu Industries Ltd agreed to compensate Mr Madow but later changed their mind forcing Mr Madow to engage the services of an advocate who then sent a demand note to the company. Evidence now shows that the businessman suffered irreparable financial loss.
