The Board of Management of Sigalagala National Polytechnic is on the spot over the irregular award of tenders without following tender laws.
According to a report by Auditor General Nancy Gathangu, there was been an irregular award of tender for the supply of fuel and lubricants in which a local firm was paid Ksh.3,451,927 without following due process.
It was however discovered that the lowest recommended supplier was a different firm and no reason or documentation was provided to support the change of award. This is contrary to Section 86 (1)(a) of the Public Procurement and Disposal Act, 2015 which requires that the successful tenderer shall be the one with the lowest evaluated bid. In the circumstances, the Board of Management breached the law.
It has also been discovered that Ksh. 656,027 was paid to a local firm for the supply and delivery of foodstuffs vide tender number SNP/T/2019-2021/18 and payment was made via payment voucher number M0778 in similar circumstances.
It was however discovered that the local supplier that was awarded the tender had been disqualified for being non-responsive based on the set criteria. However, no reason or documentation was provided for awarding the tender to a firm that was not responsive contrary to Section 86(1)(b) of the Public Procurement and Asset Disposal Act 2015. Consequently, the management breached the law.
