The immediate former Migori County Governor Okoth Obado is under pressure to answer queries on some irregularities and malpractices during his tenure. Between June 2019 and June 2020, Mr Obado’s administration spent Ksh. 108,894,245 as wages paid to casual workers.

Reports indicate that the management engaged casuals in various departments without the authority of the County Public Service Board as provided for by Sections 67 of the County Governments Act, 2012 which states that no appointment or assignment of duty in a county public service shall be valid unless it is evidenced in writing. Further, section 74 states that “The County Public Service Board shall regulate the engagement of persons on contract, volunteer and casual workers.

According to an investigative report seen by The Weekly Vision, the casuals were continuously engaged for more than three months without written contracts contrary to Section 9(1) of the Employment Act Cap 226 laws of Kenya.

Mr Obado has also been accused of non-compliance with the Law on ethnic composition contrary to Section 7(1) and (2) of the National Cohesion and Integration Act, 2008 which states that, “all public offices shall seek to represent the diversity of the people of Kenya in employment of staff and that no public institution shall have more than one-third of its staff establishment from the same ethnic community”.

Between 2019 and 2020, the County Executive of Migori had 2,517 employees out of which 1,775 or 71% comprised members of the dominant community in the county (Luo). This is the circumstance in; Management is in breach of the law. Mr Obado did not consider that Migori has a homogenous population which includes Suba, Kuria, Kisii, Luhya, Somalis, Indians, Arabs and Nubians.
