How EACC Averted The Loss Of Public Funds In Fictitious Tender Deals Across The Country

A report by the Ethics and Anti-Corruption Commission titled “Report of Activities and Financial Statements for the Financial Year 2021/2022” reveals how the Commission carried out 25 proactive investigations, which resulted in the averting of possible loss of public funds of approximately Ksh. 4B.

According to the report, EACC stopped payments of Ksh.372, 818,000 by the Migori County Government following an inquiry into an allegation of fraudulent payments to various merchants for non-existent projects that include construction of ward offices, road improvements, water projects and renovation of office blocks in the FY 2021/22.

The Anti-Corruption body also stopped payment of Ksh. 348,669,760 to M/s Hartland Enterprises Limited for FY 2020/2021. This followed an inquiry into an allegation of conflict of interest and fraudulent payments. The report reveals that two directors of M/s Hartland Enterprises Limited are employees of the County Assembly of Homa Bay.

Kakamega County Water and Sanitation Company also had payments of Ksh. 192,000,000 stopped by EACC following an inquiry into an allegation of procurement irregularities in Tender No. CGK/KACWASCO/DMSDS/04/05/06/2021-2022 for the procurement of a Water Treatment Facility.

The County Government of Kitui also had payments worth Ksh. 14,800,000 stopped following an inquiry into an allegation of fictitious imprest claims from the County Treasury by county staff for work not done in the FY 2021/2022. At the County Assembly of Kericho, EACC stopped payments worth Ksh. 10,012,000 following an inquiry into the allegation of procurement irregularities in a tender for the provision of legal services in the FY 2021/2022.

The County Government of Machakos also had a tender worth Ksh. 5,938,823 stopped following an inquiry into an allegation of conflict of interest in Tender No. GMC/KUSP/023/2018-2019 awarded to Wisdom Holdings Ltd associated with an employee of the County. The report also reveals how EACC averted the loss of public funds worth Ksh. 4,138,880 by the County Government of Bungoma following an inquiry into an allegation of embezzlement of public funds in Tender No. BGM/CNTY/OT/CEF/258/2018-2019 for road construction awarded to Ms Limassol Limited.

At Meru University, EACC stopped payments worth Ksh. 67,000,000 following an inquiry into the allegation of procurement irregularities in Tender No.MUST/009/2018-2019 for sewer construction at the University, the tender was eventually cancelled.
